Terms of sale

Who we are

The seller is Proshyan Brandy Factory LLC («Պռոշյանի կոնյակի գործարան» ՍՊԸ), tax ID 03302375, the producer of TUFF Armenian brandy. Full details are at the end of this page. These terms apply to orders placed on tuffbrandy.com and to engraving orders made in our engraving studio. Nothing in them limits the rights consumers have under the law of the Republic of Armenia.

Age 18+

• We sell alcoholic beverages only to adults. In Armenia the sale of alcohol to persons under 18 is prohibited (Law on Trade and Services, Art. 9).
• By ordering you confirm that you are at least 18 years old, or of legal drinking age in the country of delivery if it is higher.
• The courier checks an identity document at handover. We do not hand over an order to a person under 18 or without ID; in that case the order is cancelled and any payment is refunded.
• If the law of the country you are in does not allow you to view information about alcoholic beverages, please do not use this site.

How an order is made

• You choose the products and the delivery, enter your details and confirm with the button "Order with obligation to pay". Before that button you see the products, their main characteristics, the total price including VAT and the delivery cost.
• We confirm the order by email (a durable record of the order and these terms) and, if needed, by phone. The confirmation reaches you no later than delivery.
• We may decline or cancel an order if a product is no longer available, the details cannot be confirmed or the buyer is under 18. Any payment is then refunded in full within 14 days.
• Engraving: the design you send from the studio is a request. The contract for an engraved bottle is made when we send you the final proof with the price and the date and you confirm it (by paying the invoice or in writing).

Prices and payment

• Prices are in Armenian drams and include VAT (20%). Delivery is shown separately at checkout. Bottles of the same product are sold at the price shown on the day of the order.
• Ways to pay: by card online on the secure page of the bank (ACBA Bank, ArCa system; we never see or store card data); in cash or by card at pickup; by bank transfer under our invoice (for companies and on request).
• Invoices must be paid by the date shown on them. Pay only to the accounts printed on the invoice and on your order page on tuffbrandy.com; our accounts never change by email or message.
• We issue fiscal cash-register receipts (ՀԴՄ) as the law requires: for an online card payment, a prepayment receipt at once and the sale receipt when the order is handed over.

Delivery

• Delivery options, areas, times and prices are on the Delivery & returns page and at checkout.
• Unless we agree otherwise, we deliver within 30 days of the order. If we cannot, you may cancel the order and we refund all payments.
• The risk of loss or damage passes to you when you (or the person you named) receive the order.

Your right to withdraw (14 days)

• If you are a consumer (a private person buying not for business), you may withdraw from an online purchase without giving any reason within 14 days of the day you receive the goods (for an order in several parts, from the last part).
• To withdraw, tell us before the 14 days end: write to info@tuffbrandy.com or use the contact form, with the order number and the words "I withdraw from the purchase". We confirm receipt by email.
• Send or bring the bottles back within 14 days of telling us. They must be unopened, with the cap, seal and excise stamp intact, in their gift box.
• We refund everything you paid, including standard delivery, within 14 days of receiving your withdrawal, using the same payment method. We may wait until we receive the bottles or proof that you sent them. The extra cost of a faster delivery you chose is not refunded.
• You pay the direct cost of returning the goods. In Yerevan we can collect them; we will tell you the price before collecting. You are responsible for any loss of value caused by handling the goods beyond what is needed to see them.

When the right to withdraw does not apply

• Engraved or otherwise personalised bottles, made to your design (Law on Protection of Consumer Rights, Art. 23(2)(a)): they cannot be returned or exchanged unless they are defective.
• Bottles whose seal has been broken after delivery: brandy is a sealed product that cannot be returned for health and hygiene reasons once opened (Art. 23(2)(c)).
• Purchases made by companies or for business purposes: the consumer withdrawal right does not apply to them.

Defects, damage and wrong items

• Please check the parcel at handover. If the box or bottle is damaged, show it to the courier and tell us the same day if you can, with photos: this helps us solve it quickly.
• If a product is defective, damaged in delivery or not what you ordered, you have all the rights given by law: replacement, price reduction or a full refund. Tell us within two months of discovering the problem; claims can be made within the shelf life of the product and the legal guarantee period.
• We collect the product at our cost. A refund is paid within 10 days of your claim, a replacement within 7 days (or longer if a check of quality is needed, as the law allows).
• Natural tuff: every cap is cut from natural stone, so its colour and texture differ from bottle to bottle and from the pictures. This is not a defect.

Engraving

• You confirm the text, logo and layout of the engraving. Check names, dates and spelling: we engrave exactly what you approve.
• You confirm that you have the right to use the logos, names and texts you send and that they do not break the law or anyone's rights. We may refuse designs that are offensive, unlawful or that infringe trademarks or copyright.
• Engraving on glass is done with a UV laser; small differences in position and depth compared with the on-screen preview (up to about 1 mm) are normal.

Companies

• For company orders we issue an invoice with our bank details; the tax invoice (e-invoice) is issued by our accounting. Prices include VAT.
• The consumer rules on withdrawal do not apply; questions of quality are handled under the Civil Code of the Republic of Armenia.

Using the site and our content

• The TUFF name and logo, the designs of the bottles, caps and packaging, and the photographs, films and texts on this site belong to Proshyan Brandy Factory LLC or are used with permission. You may view them and share links to them; copying them or using them commercially needs our written consent.
• Please do not try to break into the site, overload it, send malicious code, or use the forms, the studio or the concierge to send unlawful or offensive content.
• Links to other sites are there for convenience. We do not control those sites and are not responsible for their content.
• We keep the information on the site accurate and up to date as best we can, but it may contain errors, and we may change or pause parts of the site. This does not limit your rights as a consumer or our duties under these terms.

Questions, complaints and disputes

• Write to info@tuffbrandy.com or use the contact form. We reply to complaints within 10 days.
• If we cannot agree, you may contact the Competition and Consumer Interests Protection Commission of the Republic of Armenia or go to court. There is no mandatory out-of-court dispute body for these sales; we are open to mediation if you propose it.
• These terms are governed by the law of the Republic of Armenia. If you are a consumer living in another country, you keep the protection given to you by the mandatory law of that country.

Changes and language

• The version of these terms in force when you place your order applies to that order.
• These terms are published in Armenian, English, Russian and Chinese. If the versions differ, the Armenian version prevails.
